COUNTY OF ROANE
BE IT REMEMBERED, that the County Commission of Roane County, Tennessee convened in regular session in Kingston, Tennessee on the 10th day of November 2008 at 7:30 P.M.
The Commission was called to order by Bailiff James Stults.
Invocation was given by Commissioner Harmon.
The Pledge of Allegiance to the Flag of the United States of America was led by James Stults.
Present and presiding was the Honorable Troy Beets and the following Commissioners: Bacon, Brummett, Cantrell, Collier, Currier, East, Goddard, Harmon, Jackson, Johnson, Olsen, Rose, Tedder (14)
Absent: Hooks (1) Commissioner Hooks was in Chicago on business.
THEREUPON Chairman Beets announced the presence of a quorum. Also present was the Honorable Mike Farmer, County Executive, Budget Director Alva Moore, Deputy Clerk Bobbie Tipton and Zoning Officer Kay Christopher.
APPROVE MINUTES OF THE NOVEMBER 10, 2008 MEETING.
MOTION was made by Commissioner Rose with second by Commissioner Olsen to approve the minutes of the November 10, 2008 meeting.

HEARING OF DELEGATION:
Brandy Cartron spoke on behalf of property located at 103 Swafford Road, Harriman, TN . The reason for this rezoning request is to allow a day care center on this property.
COUNTY ATTORNEY’S REPORT: Absent
COUNTY EXECUTIVE’S REPORT
County Executive Mike Farmer commended Oliver Springs and Roane County for working together on Building Codes and Zoning Regulations.
SPECIAL ORDERS:
Commissioner Harmon gave a jail project report.
PRESENTATION OF AWARDS TO THE VOLUNTEER FIREMAN OF THE YEAR FOR EACH DISTRICT.
1ST District VFD – Chief Randy Scarborough presented the award to Greg Cloyd.
West Roane County VFD – Chief Charlie Redwine presented the award to Stephen Koren.
East Roane County VFD – Commissioner Chris Johnson presented the award to Brian Grief.
Blair VFD award was awarded to Jeff Lawson.

RECOGNITION OF JAMES “DUB” HARMON FOR 20 YEARS SERVICE AS A COUNTY COMMISSIONER.
Chairman Troy Beets presented Commissioner James “Dub Harmon with a plaque for 20 years service as a County Commissioner.
ELECT A MEMBER TO THE INDUSTRIAL DEVELOPMENT BOARD OF THE COUNTIES OF CUMBERLAND, MORGAN AND ROANE COUNTIES TO FILL A VACANCY CREATED BY THE RESIGNATION OF MARK POWERS. (The Term expires September 30, 2010.)
Commissioner Harmon nominated Danice Turpin.
Chairman Beets asked three times for other nominations from the Commission, there being none, he opened the floor to the audience.

WHEREAS, Vanessa & Billy H. Ward have violated Resolution # 2709 by continually allowing overgrown vegetation/accumulated debris on property designated as Map 119, Parcel 5.00 are subject to Roane County Zoning Regulations and Resolution # 2709, and if they are, petitioning the court to enforce the same by granting injunctive and other relief.
THEREFORE, BE IT RESOLVED:
The County Attorney is authorized to file a lawsuit to determine whether Vanessa & Billy H. ward by continually allowing overgrown vegetation/accumulated debris on property designated as Map 119, Parcel 5.00 are subject to Roane County Zoning Regulations, and Resolution 2709, and if they are, petitioning the court to enforce the same by granting injunctive and other relief.

A RESOLUTION AUTHORIZING THE COUNTY ATTORNEY TO FILE A LAWSUIT REGARDING OVERGROWN VEGETATION/ACCUMULATED DEBRIS ON PROPERTY OF THOMAS & PATSY ROGERS BY VIOLATING ROANE COUNTY ZONING REGULATIONS AND RESOLUTION # 2709 FOR CONTINUALLY ALLOWING CONDITIONS OF OVERGROWN VEGETATION/ACCUMULATED DEBRIS ON PROPERTY IDENTIFIED AS MAP 57H, GROUP A, PARCEL 22.00.
WHEREAS, Roane County, Tennessee adopted regional zoning by adoption of Resolution # 2101 on May 4, 1990.
WHEREAS, After the adoption of a regional plan, Roane County Zoning Regulations provides that conditions of overgrown vegetation/accumulated debris such as to endanger the health, safety, and welfare of other citizens, or encourage the infestation of rats and other harmful animals must be abated.
WHEREAS, Thomas & Patsy Rogers have violated Resolution # 2709 by continually allowing overgrown vegetation/accumulated debris on their property and has generated complaints by neighboring property owners.
WHEREAS, the Roane County Planning Commission recommends that the County Attorney be authorized to file a lawsuit to determine whether Thomas & Patsy, Rogers by allowing overgrown vegetation /accumulated debris on property designated as Map 59H Group A, Parcel 22.00 are subject to Roane County Zoning Regulations and Resolution # 2709, and if they are, petitioning the court to enforce the same by granting injunctive and other relief.
THEREFORE, BE IT RESOLVED:
The county attorney is authorized to file a lawsuit to determine whether Thomas & Patsy Rogers by continually allowing overgrown vegetation/accumulated debris on property designated as Map 59H, Parcel 22.00 are subject to Roane County Zoning Regulations and Resolution # 2709, and if they are, petitioning the court to enforce the same by granting injunctive and other relief.

THEREFORE, BE IT RESOLVED:
The county attorney is authorized to file a lawsuit to determine whether C.L. & Ida Hagaman by continually allowing overgrown vegetation/accumulated debris on property designated as Map 38-0, Group E , Parcel18.00 are subject to Roane County Zoning Regulations and Resolution # 2709, and if they are, petitioning the court to enforce the same by granting injunctive and other relief.

RESOLUTION # 12-08-10
A RESOLUTION ESTABLISHING THE COMMITTEES OF THE ROANE COUNTY COMMISSION FOR A PERIOD FORM JANUARY 1, 2009 TO DECEMBER 31, 2009.
WHEREAS, much of the work and preliminary approval for the Roane County Commission is preformed by committees prior to approval by the full Commission,
WHEREAS, committee assignments are made by the Committee on Committees which consists of Commissioners Beets, Goddard, East, Olsen and Rose all appointer by the Commission at the September 2008 meeting.
WHEREAS, committee assignments are made in priority (1) the needs of the Commission, (2) the seniority of the commissioners, and (3) the wishes of the commissioners,
BE IT THEREFORE RESOLVED that the Roane County Commission hereby establishes the attached Committees of the Roane County Commission for the period from January 1, 2009 to December 31, 2009.

RESOLUTION # 12-08-11
A RESOLUTION CHANGING THE ROANE COUNTY CODE OF ETHICS AND REPLACING ROANE COUNTY RESOLUTION #01-07-03 AS AMENDED.
WHEREAS, the Roane County Commission adopted Resolution # 01-07-03, As Amended, at its February, 2007 meeting, and
WHEREAS, the Ethics Committee has met and made changes to the Roane County Code of Ethics;
NOW, THEREFORE, BE IT RESOLVED that the Roane County Commission does hereby adopt the amended Roane County Code of Ethics, attached hereto and made a part hereof.
BE IT FURTHER RESOLVED, that the attached policy replaces the present Code of Ethics (Resolution # 01-07-03, As Amended).
SECTION 1. All resolutions in conflict herewith be and the same are repealed insofar as such conflict exists.
SECTION 2. This resolution shall become effective upon passage, the public welfare requiring it.

A RESOLUTION AUTHORIZING THE RECEIPT AND APPROPRIATION OF FUNDS FROM THE ENVIRONMENTAL PROTECTION AGENCY.
WHEREAS, Roane County was successful in obtaining $96,200 from the Environmental Protection Agency to provide potable water along Paint Rock, Arnold, and Myers Roads In Roane County; and
WHEREAS, match money will be paid by Watts Bar Utility District; and
NOW THEREFORE BE IT RESOLVED that the Roane County Industrial and Economic Development Fund be amended as follows:

RESOLUTION # 12-08-13
IN THE COUNTY COMMISSION FOR ROANE COUNTY, TENNESSEE
A RESOLUTION TO WITHHOLD THE FUNDS APPROPRIATED FOR THE TENNESSEE DEPARTMENT OF HEALTH FOR USE BY THE ROANE COUNTY HEALTH DEPARTMENT IN THE GENERAL FUND (101).
WHEREAS, each year the County appropriates an amount to the Tennessee Department of Health (State), and
WHEREAS, in some years the State has allowed the County to use these funds for the Local Health Department, and
WHEREAS, for the Fiscal Year 2008-09 the State is allowing the County Health Department to use these funds for building maintenance and repair, except for salary supplements, and
WHEREAS, Fund Balance is not affected by this resolution.
NOW, THEREFORE, BE IT RESOLVED that the General Fund (101) be amended as follows:
SECTION 1. All resolutions in conflict herewith be and the same are repealed insofar as such conflict exists.
SECTION 2. This resolution shall become effective upon passage, the public welfare requiring it.

A RESOLUTION TO APPROPRIATE FUNDS INTO THE SESSIONS COURT BUDGET, IN THE GENERAL FUND (101), TO PROCESS A BACKLOG OF TRAFFIC CITATIONS.
WHEREAS, the processing of this backlog of traffic citations is essentially performed on overtime, and
WHEREAS, the amount originally budgeted for the task has been spent, and
WHEREAS, if the processing is continued, additional funds must be added to the budget, and
WHEREAS, from this point forward all processing work performed will be on traffic citations dated for the Year 2000 and later.
NOW, THEREFORE, BE IT RESOLVED that the General Fund (101) be amended as follows:
SECTION 1. All resolutions in conflict herewith be and the same are repealed insofar as such conflict exists.
SECTION 2. This resolution shall become effective upon passage, the public welfare requiring it.

RESOLUTION # 12-08-15
A RESOLUTION TO MOVE FUNDS FROM A SALARY LINE IN THE WASTEWATER TREATMENT FUND (128) TO PAY FOR ENGINEERING SERVICES.
WHEREAS, engineering services were rendered on the flow regulator, a smoke testing project, and on a lift station and autidegradation analysis, and
WHEREAS, these expenditures exceed the current engineering service budget, and
WHEREAS, none of the Supervisor/Director salary line has been spent during this Fiscal Year 2008-09, and
WHEREAS, the Fund Balance of said Fund is not affected by this
resolution.
NOW, THEREFORE, BE IT RESOLVED that the Wastewater
Treatment Fund (128) be amended as follows:

RESOLUTION # 12-08-16
A RESOLUTION TO PLACE IN SURPLUS CERTAIN EQUIPMENT FROM THE ROANE COUNTY AMBULANCE SERVICE TO DONATE IT TO THE ROANE COUNTY OFFICE OF THE UNITED WAY.
WHEREAS, the Roane County Ambulance Service has determined that a certain copier (Royal Copystar, Model 2130 – SN #029283H), and
WHEREAS, the Roane County Ambulance Service now seeks to have said copier declared surplus equipment, and
WHEREAS, the Roane County Office of the United Way has a need for the copier, and
WHEREAS, the Roane County Office of the United Way is a valuable organization in Roane County,
NOW, THEREFORE, BE IT RESOLVED that this copier is hereby declared surplus property and may be donated to the Roane County Office of the United Way.
SECTION 1. All resolutions in conflict herewith be and the same are repealed insofar as such conflict exists.

RESOLUTION # 12-08-17
A RESOLUTION TO AUTHORIZE THE COUNTY EXECUTIVE TO EXECUTE A THREE-YEAR AGREEMENT WITH ARAMARK UNIFORM SERVICES FOR THE ROANE COUNTY HIGHWAY DEPARTMENT.
WHEREAS, the Roane County Highway Department has a program to provide uniforms for the employees, and
WHEREAS, the Roane County Highway Department has researched and found that Aramark Uniform Services best fits the needs of the department and has the concurrence of the Purchasing Agent, and
WHEREAS, the County Attorney will approve the contract prior to its execution,
NOW, THEREFORE, BE IT RESOLVED that the Roane County Commission does hereby authorize the County Executive to execute a three-year agreement with Aramark Uniform Services for the Roane County Highway Department.
SECTION 1. All resolutions in conflict herewith be and the same are repealed insofar as such conflict exists.
SECTION 2. This resolution shall become effective upon passage, the public welfare requiring it.

RESOLUTION # 12-08-18
A RESOLUTION TO GIVE THE COUNTY EXECUTIVE AND/OR THE COUNTY PURCHASING AGENT THE AUTHORITY TO DISPOSE OF PERSONAL PROPERTY WITH AN ESTIMATED VALUE OF LESS THAN $300.00.
WHEREAS, it is the responsibility of the County Purchasing Department to transfer materials or equipment between departments or agencies and/or dispose of surplus equipment, and
WHEREAS, the county is doing auctions on GovDeals and the approval of this resolution will expedite the sale of surplus equipment, and
WHEREAS, often times equipment is broken to the point of being unsafe or completely unusable and should be thrown away rather than sold, and
WHEREAS, often times it would be more beneficial to the county to recycle the equipment at the County’s Recycling Center rather to sell it,
NOW, THEREFORE, BE IT RESOLVED that the County Executive and/or the County Purchasing Agent is granted the authority to dispose of Roane County personal property that is estimated to have a value of less than $300.00.
SECTION 1. All resolutions in conflict herewith be and the same are repealed insofar as such conflict exists.
SECTION 2. This resolution shall become effective upon passage, the public welfare requiring it.

A RESOLUTION AMENDING HIGHWAY DEPARTMENT FUNDS ALLOWING A TRANSFER OF FUNDS TO HIGHWAY EQUIPMENT ACCOUNT.
WHEREAS, the Highway Department needs to replace a salt spreader, tractor and side mower.
WHEREAS, Capitol Outlay accounts are not sufficient to support these purchases.
WHEREAS, Equipment Operators-Light accounts has excess funds available due to a decrease in employees in that department.
WHEREAS, the Highway Department requests that the amounts shown be transferred.
NOW, THEREFORE, BE IT RESOLVED the Highway Fund be hereby amended as follows:
